A power of attorney is an official document that allows one person (the principal) to authorize another person (the agent) to act on their behalf in various state and municipal authorities, including the Ministry of Internal Affairs (MVD) and multifunctional centers (MFC).
A power of attorney is necessary if you are unable to personally submit documents, receive certificates, obtain a passport, register at a place of residence, receive a driver's license, register vehicles, process migration documents, and perform other legally significant actions.
When is notarization of a power of attorney mandatory?
Notarization of a power of attorney is mandatory in cases directly provided for by law. For example, notarization is required for powers of attorney for transactions that themselves require notarization (such as real estate transactions), for the disposal of registered rights, and for representation in court. The requirements for notarization of powers of attorney are regulated by the Civil Code of the Russian Federation (Articles 185.1, 185.2 of the Civil Code) and the Federal Law "On Notaries".
