This document is a Motion to Review Case Files in Electronic Form. It is filed with the Arbitration Court by the applicant's (a party to the case) representative to gain access to the documents of a specific court case via the "My Arbitr" information system.
The document is used in the following situations:
- Preparing for Court Hearings: When a party to the case (plaintiff, defendant, third party) or their representative needs to thoroughly study all documents, evidence, motions, and court rulings contained in the case file to effectively defend their interests in upcoming hearings.
- Drafting Appeals or Responses: Preparing a substantiated appellate/cassation appeal or a response to a claim/appeal from the opposing party requires a full understanding of the case materials.
- Monitoring Case Progress: To track the progress of the proceedings, review newly submitted documents from other participants, or examine court rulings.
- Electronic Access: When a participant in the case wishes to conveniently review the case file remotely through the official "My Arbitr" portal without having to visit the court's office in person.
The document includes all necessary details: addressee (the court), information about the applicant (legal entity) and its representative, the case number, the judge, a clear statement of the request (to review the materials of a specific case electronically), and a reference to the relevant procedural norm (Art. 41 of the Russian Arbitration Procedure Code). Documents verifying the representative's authority (power of attorney) are attached to the motion.
