This commentary is written to help legal practitioners, judges, scientists and students interested in civil law, to orient in problematic issues of application of the provisions of Chapter 24 of the Civil Code of the Russian Federation on the change of persons in the obligation (Articles 382-392.3), the provisions of Chapter 25 of the Civil Code of the Russian Federation on liability for breach of obligation, as well as Articles 330-333, 380 and 381 of the Civil Code of the Russian Federation on the penalty and deposit

The book deals in detail with such institutions as cession, subrogation, transfer of debt, transfer of contract, debtor's default, creditor's default, recovery of losses, penalty, deposit, fault in breach, force majeure, limitation of liability clauses, compensation for property losses, etc. The authors have set out to cover in detail the provisions of Chapter 25 of the Civil Code of the Russian Federation on liability for breach of obligation. The authors set themselves the task to highlight the maximum number of complex and ambiguous issues of interpretation and application of the provisions enshrined in these articles, to reflect, if possible, all the accumulated judicial practice of application of these articles by the highest courts and, in some cases, to propose optimal ways of solving the identified problems and conflicts.
