About this item
This commentary is written to help legal practitioners, judges, scholars and students interested in civil law to orient themselves in problematic issues of application of the provisions contained in Articles 1-16.1 of the Civil Code of the Russian Federation. This book deals in detail with such issues as good faith and other principles of civil law, sources of civil law, analogy of law and other methods of filling gaps in civil law, the effect of civil law norms in time, waiver of rights, estoppel, circumvention of the law and other manifestations of the doctrine of abuse of right, recovery of damages, claims for compulsion to perform a duty in kind, recognition of a right and other methods of protection of a right, civil liability of the state and much more. The authors set themselves the task of highlighting the maximum number of complex and ambiguous issues of interpretation and application of the general provisions of the Civil Code of the Russian Federation enshrined in these articles, to reflect, if possible, all the accumulated judicial practice of application of these articles by the highest courts and, in some cases, to propose optimal ways of solving the identified problems and conflicts.
