The work presented to the readers is the first domestic monographic study devoted to information obligations arising from the principle of good faith. It is the first step towards the study of this complex and at the same time interesting topic, which is traditionally given much attention in Western civilistic studies.
Information interaction is a necessary element of any social contact. Civil-law relations are no exception. Natural antagonism of interests and natural egoism of participants of civil turnover impose a bright imprint on the nature of their behavior at the pre-contractual, contractual and post-contractual stages of interaction.
The necessity to take into account a large number of factors, which along with the rule of law are only incentives for the participants of the turnover, influencing their choice of optimal behavior, is clearly shown. The competition of these factors in influencing the behavior of a particular participant of the turnover highlights the problem of reassessing the effectiveness of law in the form of informational obligations as the only possible regulator of behavior.
duties as the only possible regulator of human behavior. The view on the principle of good faith and its actual role in the matter of judicial law-making, which is not yet very popular in the domestic doctrine, is presented. The method of economic analysis of law is actively used.
The author of the work believes that only by discussing and questioning the supposedly immutable “truths” of a century ago, one can really move forward in scientific research.
The result of the presented work is the creation of model rules of information disclosure, which can be taken as a basis for their further adaptation to one or another special relations, taking into account their peculiarities.
The book is intended for teachers of civil law, postgraduates, graduate and undergraduate students, scientific and practical workers and all those who want to expand their view of the law, using non-standard techniques and means.
